Risk of loss passes to you upon delivery to the carrier. We are not responsible for delays caused by carriers, customs, weather, or other circumstances beyond our control.

You may request cancellation before your order has been picked up by the shipping carrier. Once shipped, orders cannot be cancelled and must be returned according to our return policy.

TO THE FULLEST EXTENT PERMITTED BY LAW, POEMUSART INC. AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SHOP OR ANY PRODUCT PURCHASED.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF YOUR USE OF THE SHOP OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.
You agree to indemnify and hold harmless Poemusart Inc. from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the Shop.
These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Jackson County, Missouri, unless otherwise required by applicable law.
Before initiating any legal action, you agree to first contact us at contact@poemusart.com in good faith to attempt to resolve the dispute informally. Most disputes can be resolved through direct communication.
We may update these Terms from time to time. The "Last updated" date at the top reflects the latest version. Continued use of the Shop after changes constitutes acceptance of the new Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
These Terms, together with our Privacy Policy and Shipping & Returns Policy, constitute the entire agreement between you and Poemusart Inc. regarding your use of the Shop.
